This chapter of the book Data Protection Treaty first addresses the regulation of special categories of data under Article 9 of the GDPR, highlighting the differences with the previous regulation under Directive 95/46/EC. And on the other hand the paper examines how the Spanish Parliament has addressed this issue in Organic Law 3/2018 on data protection and the guarantee of digital rights. More specifically, the paper analyzes the problems posed by this law in regulating the processing of data relating to criminal and administrative offences, as well as the processing of data held by churches and religious associations.
