Rateio dos Custos e da Geração das Usinas Nucleares Angra 1 e Angra 2 no Sistema Interligado Nacional: Subsídios Técnicos à Consulta Pública ANEEL nº 037/2025
Abstract
This technical contribution provides regulatory and economic analysis to support the Brazilian Electricity Regulatory Agency (ANEEL) in implementing the allocation of costs and electricity generated by the Angra 1 and Angra 2 nuclear power plants among final users of the National Interconnected System (SIN), in accordance with Law No. 12,111/2009, as amended by Law No. 15,235/2025. The study examines the transition from a quota-based allocation model restricted to the Regulated Contracting Environment (ACR) to a multisectoral model that includes free consumers, self-producers and other agents operating in the Free Contracting Environment (ACL), expanding the liable universe from approximately one hundred distribution utilities to more than thirteen thousand active market agents. The methodology combines Regulatory Impact Analysis (RIA), the Five Whys Method and the McKinsey Matrix to identify systemic, fiscal and operational risks, assess regulatory alternatives and propose specific amendments to Submodule 3.6 of the Commercialization Procedures. The analysis demonstrates that centralized financial settlement through the Electric Energy Trading Chamber (CCEE) is the most efficient and secure alternative, provided that targeted fiscal and operational adjustments are implemented to ensure competitive neutrality, tariff modicity and revenue security. The correction of the historical asymmetry is estimated to reallocate between BRL 456 million and BRL 480 million per year in nuclear-related costs currently borne exclusively by captive consumers, reducing average national tariffs for this segment by approximately 2.1% to 2.4%, while incorporating free consumers and self-producers into the cost-sharing of a systemic asset from which they directly benefit.
