Abstract
This paper examines the transformation of digital platforms from neutral intermediaries into algorithmically active actors capable of shaping digital risks. It analyzes the evolving boundaries of platforms’ legal liability in light of automated content moderation, recommender systems, and data-driven governance. The study adopts a comparative legal and techno-regulatory approach, addressing judicial reasoning, risk attribution, and the recalibration of fault and causation in algorithmic environments.
