Human Rights and Legal Protections: Balancing State Authority and Individual Freedoms
Abstract
The safeguarding of human rights is fundamental to contemporary democratic government, necessitating a careful equilibrium between state power and individual liberties. This research examines the legislative frameworks, institutional procedures, and jurisprudential principles that regulate human rights protection, with a focus on the balance between security, public order, and civil liberties. The research analyzes international human rights treaties, national legislation, and court interpretations to assess the efficacy of legal protections. The research finds problems, including state overreach, inconsistent enforcement, and socio-political restrictions, through comparative analysis and case studies. Recommendations emphasize the enhancement of legislative protections, judicial oversight, and public awareness to ensure that state power does not infringe upon fundamental individual liberties.
