Strict Liability Shields: Algorithmic Provenance as a Compliance Mechanism for the EU AI Act
Abstract
The implementation of the EU AI Act (Regulation (EU) 2024/1689) introduces a "Strict Liability" regime for High-Risk AI systems, specifically under Article 10 (Data Governance). This paper demonstrates that current "Observability" practices are legally insufficient for compliance. We propose the Open Data Governance Standard (ODGS), a deterministic protocol that introduces a cryptographic "Hard Stop" mechanism at runtime, ensuring no inference occurs on unverified data. This serves as a technical reference implementation for complying with Article 10. Reference Implementation: The full open-source reference implementation of this protocol is available at [github] and published as a package on [PyPI/NPM] under the name [odgs].
