Abstract

Pre-Inference Governance is frequently mischaracterized as a software, tooling, or compliance problem. This paper demonstrates that governance does not exist structurally unless inference is preceded by an explicit, legally and institutionally grounded authorization. Contrary to prevailing industry practice, governance is defined not as a property of code, safety layers, audits, or monitoring systems, but as a top-down relationship between computational power and external authority. Where such authorization is absent, governance is structurally null—independent of outcome quality, security measures, or post-hoc controls. The paper introduces the concept of structural non-existence: inference executed without prior authorization constitutes an unauthorized act, rendering audits, safety claims, and insurability logically invalid. Silence and non-execution are therefore defined as correct system states where legitimacy cannot be established in advance. This document is canonical and non-operational. It defines architectural conditions for legitimate inference without providing implementation, deployment, or compliance guidance. ⚖️ License (Text Level) Creative Commons Attribution-NonCommercial-NoDerivatives 4.0 International (CC-BY-NC-ND-4.0) 🔒 Additional Notice (mandatory):This license applies to the text only.It does not grant authorization to implement, deploy, commercialize, certify, audit, insure, or claim governance compliance based on the described architecture.Any operational or commercial use requires a separate written license from the rights holder. 🚫 Operational Disclaimer (Canonical) This document is descriptive and architectural in nature. Where authorization cannot be established in advance, silence and non-execution are defined as valid and correct system states.
