Insurance as a Precondition for Legitimate AI Inference Structural Non-Existence of Governance without Prior Insurability
Abstract
This specification establishes insurability as a structural precondition for legitimate AI inference. It formalizes the principle that AI systems which cannot be insured prior to execution are not governable by construction, and therefore must not perform inference. Contrary to prevailing approaches that treat insurance as a post-hoc financial instrument, this paper defines insurability as an ex-ante authorization signal. Where prior insurability cannot be established, governance is structurally non-existent, audits are logically invalid, and silence / non-execution is the only legitimate system state. This document is canonical and non-operational.It defines architectural conditions of legitimacy without providing implementation, deployment, certification, or compliance guidance. Canonical Principle:AI that cannot be insured before it acts must not act. Akarkach, M.
