Abstract

Divorce in Muslim laws is viewed as "a legal and controlled process of dissolving a marriage in case of an unworkable situation wherein neither of them can enjoy a harmonious and dignified relationship." Divorce in Muslim laws relies on "Islamic legal maxims which had been derived from the Islamic Quran and Hadith, whereas Muslim laws on divorce had been developed through legal acumen and legislation in order to ensure the preservation of Muslim laws on divorce in accordance with the principles of equality, justice, and Muslim women's rights." There exist various methods in dissolving a Muslim marriage through divorce. These are divorce by the husband, divorce by the wife, divorce through mutual consent, and divorce through court decrees.
