PICIB - Plano de Integração Científico-Industrial do Brasil
Abstract
This document presents the draft bill entitled Plano de Integração Científico-Industrial do Brasil (PICIB) and establishes the Regime Especial de Superposição Científico-Empresarial (RESCE), a proposed legal framework designed to reduce structural barriers between public scientific research and technological entrepreneurship in Brazil. The proposal addresses the persistent gap between scientific production and technological innovation by introducing a regulatory mechanism that allows public researchers to simultaneously maintain their academic positions while participating in the economic exploitation of technologies and intellectual property developed from their research. The central concept of “functional superposition” seeks to align incentives between universities, research institutions, industry, and society, while preserving transparency, institutional integrity, and public accountability. The document includes: (i) an explanatory memorandum presenting the economic and institutional justification for the proposal; (ii) the full normative text of the draft legislation; (iii) mechanisms for conflict-of-interest prevention and governance through Scientific-Entrepreneurial Integrity Committees (CICEs); (iv) provisions for technology transfer and institutional return to public research organizations; and (v) the Program for Diversity in Innovation (PIDI), aimed at expanding participation of underrepresented groups in scientific entrepreneurship. The proposal is grounded in Articles 218, 219, and 219-A of the Brazilian Federal Constitution and is informed by international innovation frameworks such as the Bayh-Dole Act (United States), the Fraunhofer model (Germany), and university-industry integration policies adopted in Japan. The work aims to contribute to public policy discussion, legislative debate, and institutional modernization of science, technology, and innovation ecosystems in Brazil. This version corresponds to PICIB/RESCE v2.0 (February 2026).
