Master File: Legal Memorandum on the Politically Motivated Criminal Prosecution of Alexey Nikolaevich Nazarenko and the Disproportionate Legal Qualification of the Charges Brought Against Him
Abstract
This Master File presents a structured legal analysis of the criminal prosecution of Alexey Nikolaevich Nazarenko, an elected deputy of the Duma of the Stavropol Territory. It examines whether the charges—formally framed as economic offenses under Article 178 of the Criminal Code of the Russian Federation—reflect disproportionate criminal qualification and contain political elements. The file evaluates: compliance with international antitrust standards; proportionality of criminal intervention; adherence to fair trial guarantees; consistency with Articles 2 and 3 of the Constitution of INTERPOL; applicability of U.S. asylum standards, including nexus and well-founded fear; risks related to non-refoulement and international search mechanisms. The dossier integrates factual materials, media publications, court data, international human rights instruments, and comparative legal standards. It is intended for use before the Commission for the Control of INTERPOL’s Files (CCF), international human rights bodies, and within international protection procedures.
