Abstract

This paper presents a forensic criminological analysis of the “Juan Case”, one of the most severe and extensively documented instances of prolonged domestic torture and child homicide in Brazilian criminal history. Employing methodologies drawn from clinical criminology, forensic psychology, and victimology, the study reconstructs the criminal dynamics culminating in the death of a nine-year-old boy subjected to sustained physical abuse and ultimately homicide at the hands of his biological mother and her female partner. Central to the analysis is the perpetrators’ explicit, self-declared ideological motivation, articulated as gender-based animus—their stated justification that the crime was committed “because the victim was male.” This declaration reclassifies the case from a conventional filicide to an ideologically motivated gender-based hate crime, challenging prevailing Brazilian legal and academic paradigms that predominantly conceptualize gender violence as being directed exclusively against female victims. The paper further examines the systemic failures in social oversight that allowed more than twelve months of abuse to continue undetected, the psychopathological profiles consistent with sadistic conduct disorder and ideological dehumanization, and the implications for forensic risk assessment and early intervention frameworks. The analysis concludes by advocating for a jurisprudential and criminological expansion that recognizes male children as potential victims of gender-motivated lethal violence within domestic settings—irrespective of the perpetrator’s gender or familial configuration.
