CONSTITUTIONAL POLITICS, THE 13TH NATIONAL ELECTION AND JULY CHARTER IMPLEMENTATION IN BANGLADESH: A Formal Governance and Constitutional Accountability Analysis
Abstract
This report analyses the constitutional and legal framework governing Bangladesh’s concurrent 13th National Parliamentary Election and national referendum on the July National Charter, held on 12 February 2026. It identifies four constitutional questions of first-order importance: whether Charter proposals are compatible with the basic structure doctrine established in Anwar Hossain Chowdhury v Bangladesh;1 whether the July National Charter (Constitutional Amendment) Implementation Order 2025 was issued intra vires the constitutional powers of the President; what legal consequences attach to the BNP’s refusal to take the dual oath for Constitutional Reform Council membership; and whether the Awami League’s exclusion satisfies proportionality standards under ICCPR Article 25. The report advances a three-tier classification of Charter proposals against the basic structure doctrine, subjects the Implementation Order to detailed vires analysis grounded in comparative authority from Executive Council of the Western Cape Legislature and Others v President of the Republic of South Africa and Others,2 and provides a provisional finding on the Awami League exclusion. Seven recommendations are advanced, including skeletal draft legislative language for a Constitutional Reform Implementation Act and a Charter Implementation Monitor. The report is grounded in doctrinal-analytical methodology consistent with the standards applicable in senior appellate constitutional proceedings.
