Abstract

This paper provides a deep psychological analysis comparing the life paths of Malcolm X and Herta Brigitte Bertel. Both individuals suffered extreme early childhood trauma and fragmentation of their families of origin. The study examines the divergence between post-traumatic growth (Malcolm X) and lifelong psychological rigidity (Herta Bertel). It explores concepts such as projective identification, asymbolia, and the function of "narcissistic armor" in the context of social advancement. Ultimately, the author defines "forgiveness without reconciliation" as a strategic tool for self-liberation and the cessation of transgenerational trauma transmission. Includes a detailed biography of Herta Brigitte Bertel (1943–2024). The Limits of Justice and the Power of Documentation: An Analysis of "Soul Murder" In the confrontation with severe childhood traumatization and emotional annihilation, the question of legal accountability often arises. While physical violence and sexual abuse constitute clear criminal offenses, psychological cruelty—often referred to as "soul murder"—largely evades state jurisdiction. 1. The Legal Vacuum The term soul murder describes the systematic destruction of a person's psychological integrity. In legal practice, however, victims encounter massive obstacles: Lack of Legal Definitions: Psychological violence is difficult to grasp within criminal law as long as it does not result in a verifiable physical illness or specific coercion. Lack of Evidence: Emotional coldness, silence, and psychological manipulation leave no physical traces. In a trial, it is often a matter of "one word against another." The Bourgeois Protective Wall: Perpetrators with high social status (e.g., members of academic circles or civil servants) use their social integrity as "armor" to portray accusations as a sign of the victim's psychological instability (gaslighting). 2. The Immutability of the Perpetrator's Structure Clinical experience shows that for perpetrators whose lives are based on massive dissociation and denial, no insight is to be expected even after decades. Legal proceedings require a minimum capacity for confrontation. In a personality structure that rejects all guilt to protect its own fragile self-image, a report rarely leads to atonement but rather to an escalation of denial. Waiting for justice through an institution can thus lead to a lifelong dependency on the perpetrator, as the victim continues to hope for a validation of their suffering by third parties. 3. Documentation as an Act of Self-Efficacy When justice reaches its limits, the duty of documentation takes its place. Publishing the facts on platforms such as Zenodo, Archive.org, or Academia.edu fulfills three essential functions: Sovereignty of Interpretation: The victim leaves the role of petitioner toward the state and becomes the sovereign chronicler of their own history. Permanence: A court judgment can disappear into archives; a digital documentation with a DOI (Digital Object Identifier) is globally findable and forms a lasting corrective to the "official" family biography. Prevention: By analyzing mechanisms (e.g., transgenerational transmission), documentation contributes to social education regarding patterns of abuse.
