Abstract

This artifact is a public model amicus brief concerning the federalization of state military forces under 10 U.S.C. § 12406. The model brief addresses the statutory predicate question in Trump v. Illinois, No. 25A443, and argues that federalizing the National Guard is a conditional exercise of authority. The model brief emphasizes that emergency authority must remain tied to verifiable statutory predicates, including the conditions identified in 10 U.S.C. § 12406, and that courts must be able to test whether those predicates are present before military force is applied to ordinary civic activity. The artifact frames judicial review as a proportionality-preserving function. It argues that a preliminary injunction does not negate executive authority; it holds the constitutional boundary unless and until the factual basis required by statute is lawfully established. This is not legal advice and is not represented as a formally filed brief unless separately filed in the relevant court. It is a public model amicus brief and civic-education artifact intended for public-law readers, advocates, researchers, policy staff, students, and civic organizations.
