Abstract

This artifact is a public model amicus brief written as if submitted in opposition to Alabama’s emergency application for a stay in Wes Allen, Alabama Secretary of State, et al. v. Marcus Caster, et al., No. 25A1229, in the Supreme Court of the United States. The brief has not been filed in any court and is not legal advice. A professional lawyer would need to adapt, verify, format, cite-check, and file any actual brief. The brief argues that Alabama has not made the showing required for extraordinary emergency relief from an existing voting-rights remedy. It frames the emergency application as an attempt to unsettle an existing remedial posture without adequately accounting for the voters whose equal electoral opportunity that posture protects. The brief argues that Louisiana v. Callais should not be treated as self-executing emergency authority to dissolve existing voting-rights remedies in other States on different records. If Alabama believes the remedial posture must change after Callais, it may press that argument through ordinary lower-court application and review. But it should not receive emergency relief that treats the remedy-bearing voter as a disappearing legal fact. Using the Constitutional Physiology / Structural Flow / Federalism-as-scale-discipline / Constitutional Civic Field frame in translated form, the brief presents a court-facing argument for preserving voter continuity, representational continuity, remedial posture, and emergency-stay discipline. Its central compression is that the voter is already inside the remedial process, and emergency relief should not pretend otherwise.
