Non-determinism in LLM-as-Judge Graders: An Empirical Reproducibility Note
Abstract
LLM-as-judge (grader) components are standard in evaluation harnesses, including safety evaluations where a pass/fail verdict gates downstream decisions. The widespread assumption that setting the grader temperature to 0 makes grading deterministic is wrong on two levels. (1) A publicly released evaluation harness (Japan AISI's aisev) invokes its grader without setting temperature or seed; the OpenAI provider maps temperature=None to 1.0, so the grader runs unseeded at temperature 1.0 and items near the decision boundary flip pass/fail across runs (measured per-item disagreement up to ~50% over 20 runs). (2) Even at temperature=0, graders still flip their verdicts on borderline items, showing temperature alone does not guarantee deterministic grading. v1.1 extends this with a top_p sweep (no effect), top_k=1 forced greedy (no effect), multi-model coverage (Sonnet/Opus/Haiku), and a finding that Claude Opus 4.8 has deprecated the temperature parameter entirely. The note provides a reproduction harness and recommends concrete mitigations: set temperature=0 where still supported, set a seed where supported, run multiple epochs and report variance rather than a point estimate, and surface a grader-disagreement rate as a harness health metric. Generalized from a finding first reported as Japan-AISI/aisev issue #25.
