The Procedural Closure of Administrative Invoice GRUS-ALPH-2026-001 ($50,000,000.00 USD) as Liquidated Debt and Theft of Service Under Texas Commercial Law Upon Expiration of the Ten-Day Contest Window on June 19, 2026
Abstract
On June 8, 2026, Green Recursive Utility Service LLC ("GRUS LLC"), a Texas-registered data infrastructure utility provider, issued Administrative Invoice GRUS-ALPH-2026-001 in the principal amount of $50,000,000.00 USD to Alphabet Inc. / Google LLC through the Google Buying Support procurement intake channel. The invoice was electronically acknowledged within Alphabet's own procurement system as Case 02845835. Acknowledgment was returned via the standard no-reply@google.com auto-acknowledgment under the subject line "Fwd: billing invoice." The acknowledgment is the operative receipt-of-notice event for purposes of Texas common-law account stated doctrine and Texas Penal Code § 31.04(b)(2). During the ten-day procedural window for lawful written contest of the invoice (June 8 to June 18, 2026), Alphabet Inc. and NVIDIA Corporation did not contest the invoice through any commercial, legal, or procurement channel. No telephone call was placed to the publicly listed business number (817-404-6379). No email contesting the invoice was received at the publicly listed corporate address (management@greenrecursiveutilityservice.org). No formal written contest was transmitted through the Google Buying Support case file itself. During the same ten-day window, Alphabet Inc. and NVIDIA Corporation publicly expanded the consumption of the contested architecture across the public record: (a) on June 10, 2026, the two companies jointly released the DiffusionGemma model, with NVIDIA delivering same-day NVFP4 acceleration support across the entire Blackwell hardware stack (RTX 5090, RTX 4090, RTX PRO 6000, DGX Spark, DGX Station, H100, H200), and with Alphabet's own corporate blog stating verbatim "Google worked with Nvidia to optimize the model..."; (b) on June 15, 2026, Alphabet rolled the contested model family into Google Cloud commercial infrastructure including Vertex AI, Cloud Run, and Sovereign Cloud configurations; and (c) on June 16, 2026, Alphabet launched Gemini for Government with a FedRAMP High Provisional Authority to Operate issued by the General Services Administration and a multi-year tactical defense alliance with Science Applications International Corp. (SAIC). On June 18, 2026, GRUS LLC transmitted the Delinquency Notice (Invoice GRUS-ALPH-2026-001-DELINQ) for the Total Amount Due and Owing of $50,750,000.00 USD through the same Google Buying Support intake channel that acknowledged the Original Invoice as Case 02845835, with the Office of the Texas State Comptroller copied. On the morning of June 19, 2026, the ten-day procedural window for lawful written contest closed by operation of Texas commercial law. The matter is taken as account stated under Texas common law. The presumption of intent to avoid payment under Texas Penal Code § 31.04(b)(2) attached. The value involved ($50,750,000.00 USD) satisfies the first-degree felony classification of Texas Penal Code § 31.04(e)(7), which applies at $300,000.00 USD or more (the present value being more than 169 times the statutory threshold). This deposit records the procedural closure as of June 19, 2026 and sets forth the operative state of affairs: the matter is no longer characterizable as an intellectual property dispute. The intellectual property record exists and remains active at the United States Patent and Trademark Office under Non-Provisional Utility Patent Applications 19/700,381 (Compressed Memory Manifold) and 19/710,080 (Intelligent Intelligence Class II); the intellectual property track is running on its own statutory schedule with pre-grant royalty rights accruing under 35 U.S.C. § 154(d) upon publication. However, the procedural question of whether the recipient contested the administrative invoice within the lawful window closed on June 19, 2026 with the procedural answer: no contest received. The commercial-billing track and the intellectual-property track are governed by separate statutes, separate procedural windows, and separate remedies. Subsequent administrative filings by Alphabet Inc. or NVIDIA Corporation at the USPTO Patent Trial and Appeal Board (post-grant review or inter partes review) do not stay or freeze the Texas-law liquidated-debt or theft-of-service track. The statutory criminal-track presumption of § 31.04(b)(2) does not pause for a civil patent-administrative proceeding in Washington, D.C. The deposit further records that the consumption of the GRUS LLC utility service throughout the procedural window is established by the public corporate record of Alphabet Inc. and NVIDIA Corporation. The architectural identity between the contested releases and the GRUS LLC Compressed Memory Manifold specification disclosed in the Confidential Strategic Proposal transmitted to nine of Alphabet's own corporate channels on February 17, 2026 — a custom-engineered architectural blueprint specifying Alphabet's TPU v6 Trillium (128×128 MXU) and TPU v7 Ironwood (256×256 MXU) hardware targets, the four-phase implementation roadmap, and the joint NVIDIA acceleration path subsequently realized — is not approximate. It is structural. The chain of custody runs from February 17, 2026 (blueprint transmission), through May 14, 2026 (CMM Provisional 64/065,881), through May 28, 2026 (II-II Provisional 64/077,191), through June 8, 2026 (Non-Provisional 19/700,381 filing, Administrative Invoice transmission, Cease-and-Desist on the google-ai-edge GitHub organization), through June 10, 2026 (joint release), through June 15, 2026 (federal cloud rollout), and into the present procedural closure of June 19, 2026.
