Abstract

Krótka nota koncepcyjna identyfikująca wodny kierunek rekultywacji wyrobiska poeksploatacyjnego jako problem wieloreżimowej kwalifikacji prawnej. Tekst pokazuje, że prawidłowa ocena takiego przedsięwzięcia wymaga łącznego uwzględnienia co najmniej prawa geologicznego i górniczego, ochrony gruntów, prawa wodnego, prawa odpadowego, planowania przestrzennego oraz prawa nieruchomości. Nota ma funkcję zabezpieczającą i koncepcyjną: dokumentuje ramę problemu badawczego bez ujawniania pełnego modelu kwalifikacyjnego, sekwencji decyzji ani szczegółowej matrycy analitycznej. English title: Water-Oriented Reclamation of a Post-Mining Excavation as a Problem of Multi-Regime Legal Qualification: Concept Note This concept note identifies water-oriented reclamation of a post-mining excavation as a problem of multi-regime legal qualification. It argues that such reclamation cannot be assessed solely within a single statutory framework or as a purely technical reclamation category. The issue arises at the intersection of geological and mining law, protection of agricultural and forest land, water law, waste law, spatial planning and real estate law. The note does not reconstruct a complete qualification model or a sequence of administrative decisions. Its purpose is to provide a public authorial record of the research problem and to indicate that the key interpretative task is to determine which legal regime is primary, which regimes co-exist and which become relevant only at the stage of subsequent land development.
