Abstract

Practitioners describe the F-gas declaration requirement on import of a containerised battery energy storage system as "unclear". This paper argues the opposite: the obligation is largely sharply determinable, and its vagueness is not uniform — it is structural in precisely located places and apparent everywhere else. The problem is not a knowledge gap but an ontological mismatch between the four quantities over which Regulation (EU) 2024/573 quantifies the obligation — substance, equipment type, customs act and actor — and the identity of the object. The paper formalises the assignment logic as a finite decision graph, separates the determinable zone from the indeterminate one, locates four seams where the object fails to map onto a node's domain, and shows that a unit with HFC-based fire suppression falls under a heavier layer than the declaratory one: the Annex IV placing-on-the-market prohibition, whose only exit — the safety-requirements exemption — the Regulation deliberately devolves to national regulators. Two adjacent regimes are shown to drift in the same way: customs classification (drift of the object) and Seveso III (drift of the state).
