FHESS COMMUNICATION IX — HYBRIDITY BEFORE LEGAL QUALIFICATION: Leipzig/Halle Airport Drone Incident — 4–5 August 2026
Abstract
FHESS Communication IX develops a finding framework for examining hybridity before legal qualification, using the Leipzig/Halle Airport drone incident of 4–5 August 2026 as a concrete finding object in relation to the Situation in Ukraine. The Communication distinguishes event, perception, description, strategic reading, attribution and legal qualification. It asks how hybrid composition can become scientifically and institutionally readable without allowing the term “hybrid” itself to predetermine the applicable legal category. Building on earlier FESS and FHESS research, the Communication develops the concepts of metaphysical and sociodynamic disponibility, resonant disponibility, inner and outer hybridity, instrumentalisability, capture, CARE, AFWEER and VERWEER (defensive capacity/self-protection). Resonance, immune grammar, Bekhterev’s work on collective phenomena and experimental social psychology are introduced as scientific interlocutors and finding instruments rather than substitutes for legal determination. The submission preserves the distinction between governmental attribution, counter-reading, investigative findings and judicial qualification, while asking whether the Leipzig/Halle incident, its possible connections with the Situation in Ukraine, and the configurations through which it acquires strategic performativity can be read within existing ICC competence. This Zenodo record preserves the three-document set submitted through ICC OTPLink: the principal Communication, Annex IX-A (conceptual and scientific framework), and Annex IX-B (Leipzig/Halle finding material).
