Abstract

Abstract The Presidency of Ecuador, through the General Secretariat of Communication, issued a statement on November 6, 2024, in which it announced a proposed partial reform to the Constitution in order to exclude persons deprived of liberty, better known as PPL, from the category of priority attention groups, which are listed in Arts. 35 and 51. This statement was made in the midst of a serious prison crisis, which has motivated a deep dispute over the rights of this group and the obligation of the Ecuadorian State to protect them, which justifies the analysis of Opinion 8-24-RC / 24 of the Constitutional Court. The objective of this article is to analyze the nature of the constitutional guarantees that protect PPL, considering their state of vulnerability and the protections of their rights granted to them by the Ecuadorian State. To demonstrate the aforementioned, a qualitative approach with a legal, doctrinal, and jurisprudential scope was used, in turn employing the legal theoretical method and the analytical exegetic method. The results obtained in this article reveal that the Constitutional Court analyzed and ruled that partial reform is not adequate and therefore inadmissible, given that we are facing a restriction and regression of rights. Furthermore, a survey of judges in the city of Riobamba confirmed 100% that excluding PPL from priority care groups violates human dignity and that the appropriate course of action would be an amendment or popular consultation. The conclusion is that the protection of the fundamental rights of PPL constitutes a guarantee of rights reinforced in the Constitution and international treaties.
