Balancing Innovation and Privacy: The Dual Impact of AI-Generated Imagery on Personal Data
Abstract
The exponential proliferation of diffusion probabilistic models (DPMs) has precipitated a critical conflict between technological innovation and personal data sovereignty. This paper rigorously analyzes the privacy risks inherent in large-scale generative models, contrasting the structural vulnerabilities of Generative Adversarial Networks (GANs) with the heightened memorization tendencies of diffusion architectures. We examine the mechanics of Model Inversion Attacks (MIAs) and the "Secret Revealer" phenomenon, demonstrating how sensitive biometric and medical data-exemplified by the LAION-5B dataset incidentscan be extracted from latent space. The analysis evaluates the efficacy of current regulatory frameworks, specifically the disconnect between the GDPR's "Right to Erasure" and the technical reality of "algorithmic shadows," while assessing "algorithmic disgorgement" as a necessary enforcement mechanism.Furthermore, we critically assess technological countermeasures, identifying significant limitations in adversarial perturbations like Glaze and Nightshade against robust mimicry , and the failure of machine unlearning protocols to withstand relearning attacks (DiMRA).We conclude that without verifiable data supply chains and legally mandated model destruction for non-compliance, the privacy of data subjects remains fundamentally compromised.
