Algorithmic Nudging, Hypernudging and the Transformation of Consent in European Private Law
Abstract
This article examines the implications of algorithmic nudging and hypernudging for European private law. It argues that AI-driven choice architectures shape preferences and blur the boundary between influence and manipulation, challenging the validity of consent and traditional doctrines. The paper proposes a design-oriented approach grounded in autonomy, good faith, and emerging EU regulation.
