Mehrfachbeteiligungen an Personengesellschaften
Abstract
The partnership law adheres to the traditional principle of uniformity of membership (uniformity principle). According to this principle, a partner's membership cannot be divided into two or more shares, so that a newly acquired share is automatically combined with the existing share. Is it time to abandon the uniformity principle for partnerships? Although this question has been the subject of intense debate, no general consensus has yet been reached. Against the backdrop of the MoPeG coming into force, a revival of the debate seems inevitable, which is the task this study sets itself.
