Abstract

Juvenile delinquency is a multifaceted social and legal phenomenon in contemporary society. Islamic criminal law, which is rooted in the Qur'an and Sunnah, has a unique doctrinal structure in relating culpability of minor offenders. Studies show that in the framework of Islamic jurisprudence a juvenile does not come under the full criminal responsibility but at the same time, the legal system tends to focus on rehabilitative discipline (Ta'dib) and moral instruction. On the other hand, modern criminal law has established specific systems for delinquents that include juvenile courts, dedicated correctional facilities, and rehabilitation programmes. This paper first explores the liability of minors in relation to the concept of Qur'an and Sunnah, and then analyses the viewpoints of the four principal schools of Islamic jurisprudence (Madhhabs). It further provides a comparative assessment which includes the Children Act of Bangladesh, international instruments, and particularly the Convention on the Rights of the Child (1989) and the contemporary judicial system. Sociological and psychological evaluations indicate that juvenile delinquency is, in almost all circumstances, caused by familial, environmental, and social factors; therefore, this also means that the most successful way to remedy this issue is through educational and psychological rehabilitation. The findings show that both Islamic and modern legal systems emphasize reformation, moral education, and rehabilitation rather than punishing juvenile offenders. Islamic law, however, has a larger focus on moral and spiritual edification, whereas modern law is much more focused on social security and psychological support. The study concludes that integration of Islamic moral education involving modern rehabilitative policies is imperative in the prevention of juvenile delinquency, thus facilitating the transition of juvenile offenders to responsible and ethical citizens in the future.
