Abstract

The article focuses on the analysis of the European legislative framework dedicated to environmental protection, highlighting the features of Directive 2004/35/EC, which establishes a liability regime for environmental damage, and Directive 92/43/EEC, known as the Habitats Directive, aimed at the conservation of natural habitats and species of flora and fauna. It explores the fundamental distinctions between these legal acts, emphasizing the necessity of an integrated strategy that facilitates synergy between economic development and ecological conservation, thereby ensuring sustainable management of natural resources. Additionally, it examines the importance of art. 6 of the Habitats Directive, which mandates the environmental assessment of planned activities and policy and planning documents concerning Emerald sites, known in national legislation as biodiversity assessments. This provision reflects a preventive approach aligned with the precautionary principle, stipulating that any initiative with potential significant negative impact must undergo a detailed analysis. Thus, the article underscores the interdependence between the responsibility of economic operators and the imperative of biodiversity conservation, highlighting both the challenges and opportunities arising from the implementation of these complex regulations in the contemporary ecological context.
