Aspecte comparative ale condamnării cu suspendare parțială și condamnare cu suspendare condiționată a executării pedepsei
Abstract
To optimize the fight against crime, criminal law provides for a number of alternatives to imprisonment, such as probation and partial suspension of the execution of the sentence. Probation allows the execution of the sentence to be deferred for a probationary period, provided that the convicted person behaves appropriately. If they comply with the obligations imposed by the court, they are rehabilitated and no longer serve their sentence. Otherwise, the sentence is enforced. Partial suspension combines a period of imprisonment with probation, offering the chance of rehabilitation without serving the full sentence in prison. Both measures are designed to reduce the negative effects of imprisonment, such as family disintegration and contact with recidivists. They also offer the state financial savings and the opportunity to re-educate offenders outside prison. However, these measures cannot be applied to particularly serious and exceptionally serious crimes.
