Spălarea banilor: aspecte teoretice și practice
Abstract
The excerpt provides an in-depth analysis of the phenomenon of money laundering and its history, focusing on the evolution of the mechanisms used over time to hide the origin of illegal funds and their impact on the global economy. Money laundering has become a sophisticated practice whereby illicit profits are integrated into the legal economy, thus giving an appearance of legality to these sums. The process involves converting funds obtained through crime into legitimate assets, and the methods used include changing the shape of the money and transferring it through various jurisdictions, such as offshore areas or bank accounts in countries with lax financial regulations. Historically, the phenomenon dates back to antiquity, but it was formalized in the twentieth century, especially in the context of the activities of the American mafia led by famous figures such as Al Capone. Although the origins of the term "money laundering" were symbolized by the use of laundries, where illicit proceeds were "cleaned up," laundering mechanisms became much more complex and sophisticated. At the legislative level, international conventions, such as the Vienna Convention (1988) and the European Convention of Strasbourg (1990), have clarified and defined the process, trying to cover a wider range of sources of illegal income, not only from drug trafficking. Thus, the current regulations recognize the importance of combating money laundering in order to protect the economy and security of states.
