Abstract

The study aims to identify the subjective side of offenses of interference with the administration of justice and criminal prosecution (Article 303 of the Criminal Code of the Republic of Moldova). The analysis concludes that the offenses specified in Article 303 of the Criminal Code of the Republic of Moldova are committed only with direct intent. It has been demonstrated that the purpose of the offenses outlined in Article 303 is a specific one, serving as a necessary element. It has also been established that the reason for the offense is not relevant for qualifying the acts under Article 303 of the Criminal Code of the Republic of Moldova, as it is an optional sign. Establishing the reason for the crime is important for individualizing the punishment.
