Abstract
The study performs an analysis of the peculiarities and perspectives of the transaction implementation as a process of conciliation to the stage of initiation of enforcement proceedings, in the light of the amendment of the Execution Code, reported to the guarantees established by art.6 § 1 of the ECHR with regard to free access to justice, the enforcement of final judgments and the debtor"s guarantees in the framework of the enforcement procedure
