Abstract

This material presents an in-depth study of the role and impact of the State Labor Inspectorate in the process of ascertaining and examining administrative offenses, with a focus on the specific areas of competence of this administrative authority. We concentrated on two essential aspects: State Labor Inspectorate competence in ascertaining offenses and its competence in examining and resolving offence cases pertaining to labor legislation and occupational safety and health. To substantiate this study, we utilized a variety of sources, including relevant normative acts, current practices in applying administrative sanctions. Additionally, a detailed legal analysis of the main types of offenses within State Labor Inspectorate jurisdiction was conducted, viewed through the lens of their constituent elements. We believe this material will be a valuable resource for law students interested in labor law and administrative offense law, as well as for legal practitioners, offering applicable perspectives for their work.
