Abstract

The appeal of concept of democracy and constitutional rule of law practice was very strong in the first years after the declaration of independence of the Republic of Moldova. Our scholars enthusiastically took over the works on the principles and values of the rule of law without engaging in the democratic character of the rule of law, highlighting first the freedom and rights of the person, although the rule of law also includes other defining elements. Coming from a totalitarian regime, obviously a democratic culture could not be practiced suddenly, the emphasis had to place on the quality of the human resource. Democracy and rule of law form an indestructible binomial. Constitution provides institutional means and procedural tools for democracy's self-control, through which democracy can check its own path, based on freedom, equality and participation.
