Interpretation of the Constitution of the Republic of Moldova: Implementation of the Recommendations of the European Commission for Democracy through Law by the Constitutional Court
Abstract
In a legal system, constitutional stability is essential for maintaining order and ensuring the existence of a constitutional mechanism that responds to the current needs of society. An essential role in establishing and maintaining the constitutional order is played by Constitutional Courts, whose primary purpose is to interpret the constitution in a dynamic manner, but within a framework that respects the fundamental principles of the constitutional order, avoiding amendments or interpretations that would undermine fundamental rights and democracy. In this respect, we note that the Venice Commission emphasizes that any interpretation of the constitution must be in line with international standards and must ensure a legal framework taht protects democracy, human rights, and the rule of law in the face of political and social challenges
