Abstract

The need to apply criminal liability for the act of home invasion is dictated by the social significance of the constitutional right to the inviolability of the home. It is essential to ensure the protection of secrets, as well as of acts that take place within the family or within the family spectrum. All this determines the need for a comprehensive and scientific study of the investigated topic, from which the topicality and importance of the topic can be deduced. It should be noted that home invasion is often found as part of other crimes such as burglary, rape, murder, in this regard it is important to know how liability will be applied for each of these cases. Judicial practice has shown that this subject meets a series of qualification problems. There are also quite serious gaps in the doctrine. The topicality of the topic also lies in the fact that this topic is very rarely addressed in the specialized literature, which requires being developed, argued and processed in a more in-depth way.
