Material liability in the framework of forestry legal relations
Abstract
This article highlights some aspects of material liability, which while being a part of legal liability, follows such tasks as: preventing the actions of the parties to the individual labour contract that would cause some material damage; recovering the damage already caused; warning other subjects about the consequences of illegal actions and sanctioning the person guilty of causing damage. In essence, material liability represents the obligation of one of the parties to the individual labour contract to repair the damage caused to the other party and stems from the fact that the labour obligations assumed by the parties under the individual labour contract are to be performed in the appropriate manner, in good faith, at the set place and time. Material liability is a part of legal liability, similar civil patrimonial liability, but which is characteristic for labour relations, and enacting thereof represents a way of defending the rights and interests of the parties to the individual employment contract.
