The procedure for endorsing the existence of the justifiable impediment - between certification and contractual protection
Abstract
This article examines the procedure for endorsing the existence of the justifiable impediment, an essential legal mechanism in an economic and social context marked by instability, global risks and unforeseeable external factors that impact contractual relations. The research aims to highlight the normative foundations, the procedural stages and the effects of the endorsement on contractual obligations, including its role in preventing disputes. The study clarifies the legal nature of the endorsement and analyses its evidentiary effects, with an emphasis on the interaction between event certification and contractual protection. It also integrates a comparative and case-law perspective, highlighting differences between national and European approaches. The conclusions underline the need to standardise the procedure and strengthen the preventive role of endorsement in protecting contracting parties, as well as its potential to contribute to the stability and predictability of the legal and economic environment.
