Abstract

AbstractThe requirement to provide grounds and reasons for administrative acts constitutes a core guarantee of the Rule of Law and a significant expression of the principle of legality in the exercise of administrative functions. However, its progressive interpretative expansion has generated substantial tensions in defining the scope of judicial review and in respecting the margins of discretion granted to the Administration. This article critically examines the scope and limits of the duty to give reasons for administrative acts, distinguishing it from normative grounding and analysing its instrumental function in verifying the lawfulness of administrative action. From a doctrinal and reflective perspective, it argues that reasoning cannot be conceived either as an obligation to provide exhaustive justification or as an indirect mechanism for reviewing the merits or expediency of the administrative decision. It is further contended that the requirement to give reasons must be interpreted in harmony with the presumption of legality of administrative acts and with the nature of discretionary powers, avoiding its overextension and the risks of substituting administrative judgment with the criteria of the reviewing body. Finally, the article highlights the institutional consequences of an expansive understanding of the duty to give reasons, particularly in terms of administrative efficiency, legal certainty, and the balance between state functions.
