Abstract

AbstractThe extension of the labor rights protection procedure (tutela laboral) to public employment has generated significant dogmatic and institutional tensions, particularly regarding the role of the administrative act and the presumption of legality that supports it. This article offers a critical analysis of the evidentiary standard applicable in tutela actions brought by public officials, arguing that the presumption of legality of administrative acts is a structural element that cannot be automatically neutralized merely by filing a tutela action. From a dogmatic perspective, it is argued that the complaining public official must provide specific and sufficient factual elements that reasonably rebut this presumption, thereby enabling only at that point a heightened form of judicial review. The study examines the risks associated with the implicit reversal of the burden of proof and with substantive review of the administrative merits, as well as the institutional consequences of an expansive understanding of labor tutela within the statutory public employment regime. Finally, the article proposes a balanced integration of tutela into the public employment regime, one that respects the principle of legality, the presumption of legitimacy of administrative acts, and the limits of judicial review.
