PROPIEDAD INTELECTUAL Y DERECHOS DE AUTOR EN AMÉRICA LATINA (PROPUESTA ALPI) - DOI:
Abstract
Abstract Latin America faces one of the deepest gaps globally in the protection of intellectualproperty and copyright. The limited regulatory coordination, weak transnationalenforcement, and the absence of regional public policies have undermined the rights ofauthors and creators. This article proposes the creation of a Latin American IntellectualProperty and Copyright Agency, inspired by mechanisms such as the United States DMCA,but adapted to the sociocultural reality of the region. The agency would have authority overregistration, enforcement, and protection of trademarks, works, and related rights, withspecial emphasis on respect for the cultural, social, and demographic traditions of theregion. The need for a standardized regional regulatory framework that revalues the moral, natural, and inalienable right of authors over their creations is also discussed
