Relating the Prosecutor’s Strategic Development Security Mandate to the Strengthening of Corruption and Environmental Supervision in Regional Strategic Projects
Abstract
The expansion of the Strategic Development Security (PPS; in Indonesian) mandate within the Indonesian Attorney General’s Office to Regional Strategic Projects (PSD; in Indonesian), in the context of corruption prevention, has not yet been supported by an integrated ecological–social normative framework. As a result, the current regulatory design remains insufficiently responsive to potential manipulation and environmentally harmful criminal practices. This research aims to critically examine the normative gaps within PPS policy and to strengthen the ecological function of PPS as exercised by the Attorney General in relation to PSD. Employing a normative legal research method with a statutory approach, the research evaluates legal gaps in legislation governing criminal procedure that are relevant to the Attorney General’s PPS authority. The findings show, first, that although the PPS regulatory framework provides a formal legal basis for prosecutorial involvement in safeguarding strategic development at the regional level, it leaves substantive normative gaps, particularly due to the absence of mandatory environmental compliance standards as an integral component of supervision. Second, the enhancement of the ecological function of PPS may be pursued through three interrelated approaches: integrating ecological–sociological principles into the implementing regulations of PPS for regional strategic projects; strengthening coordination among PPS actors as an instrument of non-penal criminal policy; and standardizing PPS mechanisms for regional strategic projects. Accordingly, the integration of an ecologically oriented PPS framework within PSD is expected to ensure procedural justice, promote a more equitable distribution of the benefits of strategic projects, and mitigate corrupt practices
