Abstract
Martin Sunnqvist, «EU's legal history in the making».Substantive Rule of Law in the Deep Culture of European Law / «La storia giuridica dell'Unione europea in divenire»: lo Stato di diritto sostanziale nello strato profondo della cultura del diritto europeoThis article is divided into three parts.First, the rule of law and the Rechtsstaat are discussed as part of the deep European legal culture. The model of understanding law is discussed and the relationship between the expert legal culture and the legal culture of the general public is developed.Second, the development of the concept of the rule of law is discussed.Even though it is only more recently that this concept has been brought into treaties and regulations, the main component principles developed much earlier in the case-law of the Court of Justice of the European Union, in part even in the 1960s and 1970s.Adhering to the rule of law is not only a criterion for joining the EU, but the rule of law is also an essential part of EU law.In the final section of the article, the question is posed as to whether we can only look back nostalgically to a time when the rule of law was seen as a concept for the future. The conclusion drawn is that the rule of law is in fact well-established in the deep legal culture of European law, that it has become much clearer as a concept in recent years, and that it has strong and broad support. However, we are witnessing legal history in the making in the EU, as the rule-of-law crisis continues and as action is taken to overcome it.Il presente contributo è suddiviso in tre parti.
