Abstract

This reflection article examines the multifaceted impact of technology on the configuration of the criminal landscape in Ecuador, moving beyond descriptive analysis to delve into a fundamental critique of the state's response. Accelerated digitalization, while a driver of development, has catalyzed the emergence of cybercrime and the sophistication of traditional offenses, positioning the country among the nations with the highest rates of cyber threats in the region. The article analyzes the dual role of technology, both as a criminal instrument (computer fraud, identity theft) and as a tool for control and prevention (surveillance cameras, digital forensic analysis). It is argued that, despite the existence of key regulations such as the Organic Comprehensive Criminal Code (COIP) and the Organic Law on Personal Data Protection (LOPDP), the legal framework lacks the necessary speed and specialization to combat an exponentially evolving threat. A deep analysis is introduced on Digital Criminalistics and the challenges of electronic evidence, pointing to the digital chain of custody as the weakest link in contemporary criminal procedure. Finally, it is proposed that contemporary citizen security in Ecuador demands a new paradigm combining strategic technological investment with specialized training for judicial operators and the strengthening of international cooperation, essential pillars to guarantee the effectiveness of state punitive power in the ciberspace and move towards a true Ius Poenale Digitalis.
