Abstract

This article analyzes the control and governance of professional councils in Brazil in light of the case law of the Federal Supreme Court, the performance of the Federal Court of Accounts and contemporary trends in transparency and data protection. Based on a qualitative literature review, it examines the legal status of professional councils as special autarchies, their social role in regulating and supervising professional practice, and the implications of managing parafiscal revenues. The paper also discusses the inductive role of the Federal Court of Accounts in demanding modern governance practices, strategic planning, internal control and accountability, as well as the impacts of the Access to Information Law and the General Data Protection Law on the administrative organization of these entities. The results indicate that professional councils are undergoing a transitional process, with relevant advances but also significant challenges in consolidating governance models aligned with transparency, integrity and the protection of the fundamental rights of citizens and regulated professionals.
