Valideynlik hüquqlarından məhrum olma: uşaqların ən yaxşı maraqları kontekstində
Abstract
The article analyzes the deprivation of parental rights from the perspective of ensuring the best interests of the child. It examines key international instruments, including the United Nations Convention on the Rights of the Child, adopted by the UN General Assembly on 20 November 1989; General Comment No. 14 of the Committee on the Rights of the Child on the right of the child to have his or her best interests taken as a primary consideration; the European Convention on Contact concerning Children; the Council of Europe Guidelines of the Committee of Ministers on Child-Friendly Justice; the Charter of Fundamental Rights of the European Union, as well as other international instruments relating to the rights of the child. It is concluded that the prolonged examination of cases concerning the deprivation of parental rights leads to serious violations of children’s rights, continued acts of violence against them, and the absence of urgent and immediate measures to protect the rights of affected children. Therefore, it is deemed appropriate to treat cases on the deprivation of parental rights as a priority and to optimize procedural time limits for their consideration. Keywords: parental rights, child rights, child protection, deprivation of parental rights, restriction of parental rights, abuse of parental rights, parental responsibility, best interests of the child, guardianship, procedural terms.
