İnzibati hüququn korrupsiya və qulluq mənafeyi əleyhinə olan digər hüquqa zidd əməllərə yanaşması: cinayət qanunvericiliyinin oxşar normalarının tətbiqi mexanizmləri
Abstract
The article examines the approach of administrative law to corruption and other unlawful acts against official interests on the basis of the mechanisms for the application of similar norms of criminal legislation. In this direction, extensive analyses are carried out on the basis of important international documents adopted and the legislation of the Republic of Azerbaijan. It is specifically noted that although corruption crimes and other crimes against official interests in the legislation of the Republic of Azerbaijan are directly reflected in the Criminal Code, similar norms of these acts are not reflected in the Code of Administrative Offences of the Republic of Azerbaijan. Taking this into account, the necessity of reflecting the mentioned similar norms in the legislation on administrative offences should be considered one of the main features characterizing this research. Accordingly, the research arrives at such a well-grounded conclusion that, in order to complement the effective organization of the fight against corruption with administrative legal mechanisms, fill the gaps in legislation, ensure proportionality, and make the fight effective, it is appropriate to define more precisely separate elements and sanctions in the Code of Administrative Offences for acts of a corrupt nature that do not constitute a crime. Furthermore, it should be noted that the application of administrative liability in this field does not merely serve a punitive function, but also acts as a preventive and early intervention mechanism. Keywords: administrative law, corruption crimes, official interest, criminal legislation, application mechanisms, criminal liability, civil liability.
