Abstract

This article analyzes issues related to the ways of changing the object of criminal law protection in collaborative activity. Attention is paid to the specific change in social relations, which are characterized not only by the corresponding influence of the subject of the relation, but also by the change in these relations due to objective reasons. Clarification of these issues will make it possible to objectively and professionally establish the conditions and methods of changing the object of criminal law protection, which is the basis for making the right decision when qualifying the committed criminal offense. Attention is focused on the fact that all types of criminal law action on the subject of social relations are divided into two groups, which are characterized physical and psychological impact. It is pointed out that collaborative activity contains a large number of ways of its commission, and these ways of changing the object of criminal law protection are different. At the same time, the same type of criminal-illegal action in many cases changes a significant number of social relations. It is emphasized that an incorrectly defined object of criminal law protection affects the qualification, as it does not take into account the direction of the guilty person's action on a specific object. It is highlighted that under certain circumstances, an act aimed at one object causes harm to other areas of social relations, and therefore such a circumstance can significantly affect the qualification of the act. It is noted that when committing collaborative activity through psychological influence on a person, such an act can also affect other persons, since the criminal-illegal influence is not limited only to this person. The main goal of the guilty person is to change social relations to achieve their personal goal. Its realization can be achieved by a corresponding impact on any member of society. It is emphasized that in some cases such a goal is of a concrete nature, for example, when a collaborator transfers material resources to illegal armed or militarized formations created in the temporarily occupied territory. Damage to a significant part of social relations consists in the rupture of the social bond that constitutes its content by the subject of the relations. The change in social relations is explained by the diversity of social life and the dialectics of his development. It is emphasized that the commission of a criminal offense by breaking the social bond shows that the object of criminal law protection is social relations, and not any things, objects or people.
