Xác lập quyền hưởng dụng trong thừa kế
Abstract
The death of an individual, in addition to resulting in the transfer of ownership of the decedent’s property to the heirs, may also constitute a legal fact giving rise to the establishment of usufruct rights in favor of other subjects, pursuant to a testament, agreements among co-heirs, or statutory provisions. The article examines the provisions of the 2015 Civil Code and related regulations as well as references to the laws of certain countries on cases of establishing the usufruct rights in inheritance, thereby identifying the shortcomings and proposing to improve provisions on establishing the usufruct rights in inheritance in Vietnam.
