Abstract

This study analyzes the joint and several liability of the Honduran State in the labor sphere, highlighting its clear constitutional basis but exposing significant limitations in its application, especially during crises such as the COVID-19 pandemic. Although the regulations establish a liability regime, the lack of specific legislation and jurisdictional fragmentation hinder the effective protection of labor rights. The conclusions underscore the need for regulatory reforms and improved enforcement of judgments to ensure that this liability has a real impact. Without these changes, the risk of state liability remaining a mere formality without real effect is alarming, thus compromising the rule of law in Honduras.
