Розмежування правових категорій «збройний конфлікт» і «воєнний конфлікт» у контексті мобілізації та мобілізаційної підготовки

An outline has been formulated regarding the need for a conceptual thoroughness of the legislation of Ukraine to consolidate the definition of armed conflict in line with international standards and establish a direct link between the presence of such a conflict and the stagnation of superordinate public legal regimes, including mobilization.The author notes that whether a military conflict is considered in a doctrinal or political sense is automatically recognized as a military conflict in the meaning of international humanitarian law.At the same time, the concept of armed conflict is broader than the classical concept of war, since it does not require formal deafening and embraces a significantly wider range of actual situations of stagnation of armed force.
