Abstract

O.G. Strelchenko, I.H. Bukhtiiarova Inter-Sectoral Aspects of Administrative Liability for Violations of Land LegislationThe article provides a comprehensive interdisciplinary analysis of administrative liability for violations of land legislation in Ukraine under conditions of martial law, economic instability, and escalating environmental challenges. The axiological significance of land resources as a fundamental value of the state, a key factor of national and food security, and the primary means of agricultural production is substantiated. It is demonstrated that armed conflict, soil degradation, excessive ploughing of territories, reduction of cultivated areas, and declining crop yields significantly complicate the implementation of effective state land policy and lead to an increase in offenses in the field of land use and land protection. The state of legal regulation of land relations is analyzed, and the interdisciplinary nature of the institution of legal liability for violations of land legislation is established, combining norms of land, administrative, criminal, and civil law.It is argued that administrative liability occupies a leading place in the system of legal enforcement instruments due to its preventive orientation and practical prevalence.Particular attention is paid to the analysis of the provisions of Article 211 of the Land Code of Ukraine and the norms of Chapter 4 of the Code of Ukraine on Administrative Offenses, which define the elements of administrative delicts in the sphere of land relations.Problems of blanket legal norms, normative collisions, and fragmentation of administrative-delict regulation are identified, which negatively affect the effectiveness of law enforcement practice.Scientific approaches to improving the mechanism of administrative liability are generalized, including ideas on systematizing land offenses, expanding the range of special sanctions, and strengthening public-administrative influence in the field of land protection and rational land use.
